These terms apply when you open an account with Bulk SMS Direct or buy SMS credits from us. By using our service, you agree to them.
About us
Bulk SMS Direct is owned and run by Jacques Bezuidenhout in Pretoria, Gauteng. Contact us on WhatsApp at 012 824 4299 or by email at info@bulksmsdirect.co.za. Our website is bulksmsdirect.co.za.
1. Your account
- We open accounts for businesses and organisations once we've confirmed who you are.
- Give us accurate details and keep them up to date.
- Keep your login and API keys private. You're responsible for messages sent from your account.
2. Credits and payment
- Credits are prepaid. We load them once your EFT payment reflects in our account. Send your proof of payment on WhatsApp or by email.
- Our prices are shown on this website and are final, with no VAT added.
- Credits stay valid for three years from the date you buy them.
- We're not registered for VAT, so we don't charge it, and our invoices aren't tax invoices.
- We may change our prices for future purchases. Credits you've already bought keep their value.
3. How credits are used
- One credit sends one SMS part to one number: up to 160 standard characters, or 153 per part in a longer message.
- Messages with Unicode characters hold 70 characters, or 67 per part, so they use more credits.
- A credit is used when a message is sent to the network, whether or not the phone receives it.
4. Acceptable use
You may only send messages that are lawful and that the recipient has a reason to expect. In particular, you agree to:
- follow POPIA, the Consumer Protection Act and its regulations, the Electronic Communications and Transactions Act, and the WASPA Code of Conduct;
- send marketing only to people who consented, or to existing customers as section 69 of POPIA allows;
- start every marketing message with your business name and include a way to opt out, like Reply STOP;
- send marketing only at the times the CPA regulations allow, and to lists cleaned against the NCC opt-out registry when the law requires it;
- never send spam, scams, phishing, harassment, or illegal or misleading content; and
- never use bought or harvested number lists.
We may suspend or close an account that breaks these rules or attracts complaints. If we close your account, we refund your unused credits, less any costs the breach caused us.
5. Your content
You own your contact lists and messages. You confirm that you have the right to use them, and you're responsible for what your messages say. We handle them as our privacy policy describes.
6. Delivery
We send your messages to the mobile networks through our delivery partner. We can't guarantee that every message arrives, or arrives at a certain time, because phones may be off, out of coverage or no longer in use, and networks may delay or filter messages. Delivery reports show what happened to each message.
7. Sender names
Messages usually arrive from a number rather than your business name. A custom sender name depends on network rules and approval, and isn't guaranteed.
8. Liability
As far as the law allows, we're not liable for indirect losses, like lost profits, caused by a message that's delayed or not delivered. Our total liability for any claim is limited to the amount you paid us for credits in the 12 months before the claim. Nothing in these terms limits rights you have under the Consumer Protection Act.
9. Closing your account
You can close your account at any time by contacting us. If you do, we refund your unused credits at the price you paid per SMS, less any bank charges.
10. Changes and law
We may update these terms, and the date at the top shows when they last changed. South African law applies to these terms.
